JUDGE DENIES TEMPORARY RESTRAINING ORDER ON THE EMPLOYER SANCTIONS LAW

 
On Friday, December 21st, the Court denied the temporary restraining order and the motion for injunction pending appeal.  The Court's conclusion is that there is more harm to the public than the plaintiffs which includes Arizona Farm Bureau, but the court was unable to cite any evidence to support its conclusion.  The Court used general statements of national consequences regarding immigration without reference to specific events in Arizona.  
 
We currently have an emergency motion for injunction pending appeal on file with the Ninth Circuit of Appeals regarding the first case.
 
We continue to confer with our attorneys and will keep farm bureau members abreast of new actions as they occur.
Arizona Farm Bureau President Kevin Rogers is eagerly waiting for a court to rule on the merits of the case. “While we appreciate Judge Wake’s quick action to our request, we believe this law is still unconstitutional and at some point a judge will need to rule on that point.”
